Legal and General Affairs

Introduction

The "Complex Structure" Legal and General Affairs:
- provides support to the Strategic Directorate in institutional relations and participation and ensures the adoption of administrative measures at the same level, including those relating to agencies and institutions;
- guarantees support in innovative themes, in collaboration with the other structures involved;
- guarantees the administrative-accounting fulfilments related to relations and agreements in which IOR is part of, in the health care or institutional sphere;
- guarantees the coordination of the Institute's Privacy functions and of the collaboration with the DPO and the supra-institutional level;
- guarantees transversal support in the management of document flows and, for the parts under its responsibility, the digitalisation of processes and administrative and healthcare documents;
- guarantees the management of the authorisation process for extra-institutional assignments and, in general, the verification and fulfilment of obligations regarding incompatibility and unitary nature of the employment relationship (including the register of services);
- It supervises the management and custody of the general deposit and historical archives of the organisation, and therefore the structural and procedural fulfilments;
- It guarantees the exercise of the Disciplinary power and provides support for the exercise of the Inspection power by the competent Organism;
- It supports the management and evaluation of the institution's credits.

The structure includes the administrative pool supporting the Direction; it guarantees administrative support to the delegate for Labor Relations in activities connected with the application of institutes subject to labor relations.
- Through its internal legal department (Advocacy), it guarantees the management of the Institution's disputes, legal defence and legal advice to the Administrative, Health and Research Services, and ensures credit recovery activities in the field of legal proceedings;
- It guarantees the administrative and account management of risks covered by insurance, is responsible for the application of the Regional Programme on Safety in Care and for the direct management of claims and the entire administrative and account management path;
- It guarantees the direct management of RCT claims, including the negotiation and non-judicial settlement phase or mediation and/or legal procedures, up to the reporting of paid amounts to the Court of Auditors;
- It guarantees the proper operation of the Claims Evaluation Committee;
- It guarantees the proper operation of the Claims Evaluation Committee;
- It supports the activities of Forensic Medicine, especially regarding care pathways, relations with patients and professionals, clinical risk management and healthcare accountability;
- Provides support to professionals in the field of healthcare accountability.

To the Structure refers the RPCT-Anticorruption, Transparency and Access to Documents Support Office, which provides the following functions:
- support to the RPCT, assisting the Manager in the management of the policies, programmes and tools used to address the issue of corruption within the Institute, in the analysis and management of corruption risk, by investigating legal, organisational, risk assessment and mitigation aspects;
- Governance of the institution's transparency system and the coordination and monitoring of the relevant legal obligations;
- Legal support in dealing with access requests.

Legal Service
It guarantees the management of the Institute's contentious matters, legal defence and legal advice to the Administrative, Health and Research Services.
It ensures the activity of credit recovery in the judicial field.
It ensures the administrative and accounting management of risks covered by insurance.
It guarantees the direct management of RCT claims, including the negotiation and non-judicial settlement phase or mediation and/or legal procedures, up to the reporting of paid amounts to the Court of Auditors.a
